Discrimination
Discrimination is one of the most common claims under employment law. It is a broad term that encompasses a huge number of protected classes of people. Some people are subject to being part of numerous protected groups at the same time.
Discrimination is the prejudicial treatment against a person or group based on certain characteristics. The behavior can be positive when directed towards a group, such as affirmative action, or it can be negative behavior directed against a certain group, like redlining. When people talk about discrimination, they more frequently refer to the negative meaning of the word.
Unlawful termination can be direct or subtle. Discrimination involves treating someone less favorably because of their possession of an attribute such as:
- Sex
- Age
- Race
- Religion
- Family status
- National origin
- Military status
- Sexual orientation
- Disability
Direct discrimination, as an example, is situations like not offering a job to a woman because she is likely to take maternity leave whereas a man is not. Indirect or subtle discrimination is displayed when a company sets a condition or requirement on a job which a smaller portion of those with a specific attribute are ably to comply with, without reasonable justification.
The case Griggs v. Duke Power Company provides an excellent example of indirect discrimination. The company was using an aptitude test in job applications that was found to disqualify African Americans at a substantially higher rate than white applicants.
