Paternity Leave
Most people are familiar with the rights of new and expectant mothers when it comes to maternity leave, but few are aware that new fathers in California also have the right to time off of work.
According to the Paid Family Leave Law, both female and male workers are allowed up to six weeks of partial pay per year in order to stay home to:
- Bond with a new baby
- Bond with a newly adopted child or a foster child
- Take care of a seriously ill parent / spouse / domestic partner / child
Legal Rights
In the state of California, there are a few pieces of legislation that help ensure time off work for new fathers and mothers. If you work full time for a company with at least 50 employees, there is a good chance you are covered by the Family and Medical Leave Act and the California Family Rights Act. According to these two acts, expectant mothers are guaranteed 12 weeks of unpaid leave.
Additionally, if you pay into the State Disability Insurance Program (SDI), you can receive up to six additional weeks of paid family leave benefits.
Father’s Rights
Both new mothers and fathers have the right to partake in the paid family leave program, yet few fathers take advantage of this opportunity, as they are unaware of their rights. If you are a new father and your employer tries to deny you the benefits you deserve, they are violating the law.
