What Is Reverse Discrimination?
In a number of different employment arenas and government-funded institutions (such as public universities), historically disadvantaged groups have been given advantages over historically advantaged groups. The act of intentionally favoring a disadvantaged person or group over an advantaged person or group is known as reverse discrimination, and is highly controversial.
While reverse discrimination existed in the United States for a number of years, it has since been deemed unconstitutional. Reverse discrimination was formerly used in situations such as college admissions quotas or quotas relating to minority representation in government jobs.
However, even though reverse discrimination is considered unconstitutional, the practice does continue in some instances, as non-quota race preferences are still considered to be legal in the United States.
"Reverse Discrimination" and Affirmative Action
Many experts oppose the term "reverse discrimination," as they believe that discrimination is simply discrimination, no matter what group of people is being discriminated against. Issues related to race-based discrimination and affirmative action are still very controversial in nature, and there continues to be extensive discussion on the topics.
Groups such as the American Civil Rights Institute propose that all hiring and admissions quotas based solely on issues of race or gender should not be allowed. However, they do support affirmative action that is socio-economically based or that is based on anti-discrimination.
Employment issues connected to discrimination and affirmative action can be very confusing. If you feel that you or someone you know has been discriminated against either at work or in competition for a job, it is important to contact a legal professional as soon as possible to help determine the legality of the situation.
