Los Angeles Sexual Harassment Lawyer
What is Sexual Harassment?
Sometimes a person is not sure if he or she is being sexually harassed at work. Often the harasser will try to protect himself or herself by convincing the harassed person that they are over-reacting or need a “better sense of humor.” If you suspect that you are being sexually harassed in your workplace, but are not sure if what you are experience legally “counts,” this article may help you decide.
Legally, sexual harassment comes in two forms: “quid pro quo” and “hostile work environment.” Quid pro quo harassment is when you are offered something, such as a job or a raise, in exchange for sexual favors. It does not matter whether you accept the offer or not, or if the person making the offer ever physically touches you. Once an offer of this kind is made to you, you are being sexually harassed.
A hostile work environment is when one or more of your co-workers are constantly making you feel uncomfortable or offended. If one of your co-workers habitually makes inappropriate comments of a sexual nature, it does not matter if he or she was speaking directly to you. Many people feel uncomfortable with that kind of language, and you do not have to be subjected to it while you are working.
It does not matter if your harasser is a supervisor or not. Even if an employee is “ranked” beneath you, it is still possible for you to feel sexually harassed by them. Either the harasser or the harassed person can be male or female. Victims of harassment often suffer negative effects such as shame, anxiety and maybe even physical harm. Even if you do not experience long-term effects, however, sexual harassment is still illegal.
